Effective January 1, 2023, a new ordinance will go into effect in the City of West Hollywood which bans all smoking inside units and on patios and balconies. Smoking in the common areas was already prohibited. To the extent the ordinance conflicts with what is allowed under our CC&Rs and Rules, the ordinance will prevail and supersede our Governing Documents. This means that effective January 1, 2023, there will be no smoking allowed anywhere within HOAs located in West Hollywood whether in the common areas, in the exclusive use common areas, or inside the units.
Under the CC&Rs, any violation of the law is treated as a breach of the CC&Rs. Associations located in West Hollywood will have no choice but to enforce this new regulation.
